TechTune Performance – Terms and Conditions 1. General

By engaging with TechTune Performance Pty Ltd (TechTune Performance), you agree to the following terms and conditions.

2. Services

TechTune Performance specialises in dyno tuning, ECU remapping, and vehicle performance modifications. Services are provided as agreed upon during consultation and may be adjusted based on the vehicle’s condition.

3. Pre-Existing Faults

TechTune Performance is not responsible for diagnosing or repairing pre-existing faults before, during, or after services unless specifically agreed upon. Additional costs may apply. Customers must ensure their vehicles are mechanically sound prior to service.

4. Quotes

Quotes provided are estimates only and may change if unforeseen issues arise. Customers will be informed of changes, and approval will be sought before proceeding.

5. Payment Terms

Full payment is required upon service completion unless otherwise arranged.
Accepted payment methods include cash, EFTPOS, or bank transfer.
Late payments will incur a $25 (including GST) per day storage fee, starting 48 hours after service completion.
Vehicles will not be released until all outstanding fees are paid in full.
If payment remains outstanding for one month, TechTune Performance reserves the right to recover and sell the vehicle to cover unpaid amounts, including storage and any additional expenses. Any remaining balance after costs will be returned to the customer.

6. Force Majeure

TechTune Performance is not liable for delays or failures in service due to circumstances beyond its control, including but not limited to:

Natural disasters Equipment failure Power outages Supply chain disruptions 

7. Protection of ECU Tuning Data

All ECU tuning data, maps, and software modifications developed by TechTune Performance and its partners are proprietary intellectual property and remain the exclusive property of TechTune Performance. Customers agree that they shall not:

Copy, distribute, or share the ECU tuning data provided by TechTune Performance. Allow any third party, including but not limited to other tuners, individuals, or entities with tuning software or tools, to access, read, or extract the tuning file for research, analysis, or personal gain. Reverse engineer, modify, or create derivative works based on the ECU tuning data.

Any unauthorised access, sharing, or use of TechTune Performance and its partners' ECU tuning data constitutes theft of intellectual property. Breach of this clause will result in legal action, including but not limited to:

Civil claims for damages. Prosecution under applicable intellectual property and criminal laws. 

8. Defamation and False Statements

Customers agree not to make false, misleading, or defamatory statements about TechTune Performance, its services, employees, or partners.
Defamation includes, but is not limited to:

Posting false or misleading reviews online, including on social media, forums, or review platforms. Making unsubstantiated claims that could harm TechTune Performance’s reputation or business operations. Spreading false information about TechTune Performance’s services, capabilities, or workmanship.

If a customer has a legitimate complaint, they must first attempt to resolve the issue directly with TechTune Performance before making public statements.
Any defamatory or false claims may result in legal action, including but not limited to:

A formal cease and desist order. Legal proceedings for defamation, damages, and reputational harm. Recovery of legal costs incurred in defending false claims. 

9. Customer-Supplied Parts

TechTune Performance is not responsible for the quality, performance, or compatibility of any parts supplied by the customer.

10. Cancellation Policy

Cancellations or rescheduling must be notified at least 24 hours in advance.
Failure to provide notice may result in a fee of up to $50 (including GST).

11. Refund Policy

TechTune Performance does not offer refunds if a customer changes their mind and wishes to have their vehicle returned to factory settings. Customers must understand that performance benefits are approximate, and vehicle condition may affect these benefits.

TechTune Performance will not provide a refund if a pre-existing fault in the customer’s vehicle becomes apparent as a result of performance tuning. It is the customer’s responsibility to ensure their vehicle is in sound mechanical condition prior to tuning.

12. Insurance Coverage

Customers are responsible for ensuring their vehicle is adequately insured while in TechTune Performance’s possession.

13. Environmental and Safety Policies

TechTune Performance complies with all environmental regulations and ensures the safe handling and disposal of waste products.

14. Data Privacy

TechTune Performance adheres to Australian privacy laws. Any personal data collected will be handled securely and used only for the purposes of providing services.

15. Warranty and Liability

TechTune Performance does not provide warranties for vehicles with pre-existing faults or damage.
Customers accept all risks associated with modifications, tuning, or remapping, including potential damage.
Vehicles will undergo wide-open throttle dyno runs, which may expose or worsen pre-existing faults.
TechTune Performance is not responsible for failures of vehicle components or electronics post-tuning, including but not limited to:

Engines, transmissions, turbochargers, fuel systems, cooling systems, exhaust components, electrical modules, and ECU-related failures.

The long-term reliability of a tuned vehicle depends on factors beyond TechTune Performance’s control, such as:

How the vehicle is driven (e.g., aggressive driving, towing, racing). Maintenance and servicing practices (e.g., oil changes, cooling system upkeep, fuel quality). Pre-existing wear and tear that may not have been detectable at the time of tuning.

Due to these variables, TechTune Performance cannot guarantee the longevity, durability, or continued performance of a tuned vehicle.
TechTune Performance is not responsible for failures occurring during dyno runs caused by pre-existing mechanical or electrical issues. These failures remain the customer’s responsibility.
If a customer's vehicle damages TechTune Performance’s dyno equipment, the customer is liable for repair or replacement costs.
Vehicles left overnight will be secured in the yard or workshop, but TechTune Performance is not responsible for theft, damage, or loss while in possession of the vehicle.

16. Storage Policy

Vehicles left for more than 48 hours after service completion will incur a $25 (including GST) per day storage fee unless prior arrangements have been made.

17. Customer Responsibilities

Customers must:

Ensure their vehicle is in safe operational condition before service. Disclose any known issues or previous modifications that may affect tuning or remapping. Respond promptly to service updates or approval requests. 

18. Disputes

Customers should contact TechTune Performance directly to resolve disputes. We aim to address issues fairly and professionally.

19. Changes to Terms

TechTune Performance reserves the right to modify these terms and conditions at any time. Customers will be notified of changes before services commence.

20. Governing Law

These terms and conditions are governed by the laws of Western Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.

21. Acknowledgement and Agreement

By signing below, I acknowledge that I have read, understood, and agree to the Terms and Conditions of TechTune Performance.
